Terms and Conditions for Bookings and Fulfillment
These Terms and Conditions govern the manner in which Atlantic Media USA purchases media on behalf of our clients. By engaging our services, you agree to comply with and be bound by the following terms:
1. Media Buying Services
(a) Atlantic Media USA offers media buying services to clients, which include the planning, negotiation, and purchase of advertising space across various media platforms.
2. Client Obligations
(a) Provision of Information: Clients must provide accurate and complete information necessary for the execution of media buying services.
(b) Approval of Media Plans: Clients must review and approve media plans and schedules provided by Atlantic Media USA before any bookings are made.
(c) Compliance: Clients must ensure that all content provided for advertising complies with applicable laws, regulations, and industry standards.
3. Pre-Payment for Media Bookings
(a) Pre-Payment Requirement: All media bookings must be pre-paid by the client. Atlantic Media USA will not place any media orders until full payment is received.
(b) Payment Terms: Clients will receive an invoice outlining the cost of media bookings. Payment must be made within the specified timeframe on the invoice.
(c) Accepted Payment Methods: Payments are only accepted via credit card for media bookings. Wire transfers may be permitted for large bookings or non-digital bookings.
4. Booking and Fulfillment Policy
(d) Booking Confirmation: Upon receipt of full payment, Atlantic Media USA will proceed with booking the approved media placements.
(e) Fulfillment: Atlantic Media USA will ensure that all booked media placements are fulfilled according to the approved media plan and schedule.
(f) Delivery of Proof: Atlantic Media USA will provide proof of performance, including air checks, tear sheets, or screenshots, as applicable, to confirm that the media placements have been executed as agreed.
(g) Adjustments: If any adjustments to the media plan are necessary due to unforeseen circumstances, Atlantic Media USA will notify the client and seek approval for any changes and payments or refunds due.
5. Cancellation and Refunds
(a) Cancellation Policy: Clients may cancel media bookings by providing written notice. Cancellation fees may apply depending on the terms of the specific media vendor.
(b) Refund Policy: Refunds for pre-paid media bookings will be processed in accordance with the cancellation terms and any applicable vendor policies. Refunds will be issued for the unused portion of the pre-paid amount, less any cancellation fees.
6. Limitation of Liability
(a) No Guarantee of Results: Atlantic Media USA does not guarantee specific outcomes or results from media placements. The effectiveness of media placements is subject to various factors beyond our control.
Liability Cap: Atlantic Media USA’s liability for any claims arising from media buying services is limited to the amount paid by the client for the specific media placement in question.
7. Amendments
(a) Atlantic Media USA reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the revised terms.
8. Consent and Acknowledgement
(a) By engaging the services of Atlantic Media USA, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
